Liquidation and bankruptcy
There is a good reason why creditors want to avoid someone going into bankruptcy – there is less chance of recovering your money if an individual declares themselves bankrupt! Similarly for the liquidation of a company, agreements where monies can be repaid over time are far preferable in most cases. Once a bankruptcy has been decided, there are various other people who will get paid before the credit – government departments, trustees, advisors and so on. The person who initiates the legal proceedings also has no guarantee that their costs will even be covered. There is a particular order of payment, with unsecured creditors appearing last on the list after various others such as the PAYE system, VAT, wages arrears and others.
IVA – Individual Voluntary Arrangement
So it would appear that bankruptcy is rarely a good thing for anyone, particularly not the creditor. Rather than undergo the often futile process an IVA can be arranged that is itself legally binding. When the person in debt cannot repay at the rate agreed previously, an IVA can allow for monies to be paid back over a greater period of time or at a lower amount per payment. A percentage of the total sum can be agreed upon which counts as the full sum owed over a period of five years. However an IVA is only granted when creditors holding more than 25% of the amount owed agree. Crucially, once an IVA is in place, court action cannot be taken against a debtor.
